The City of La Porte requires all residential swimming pools, spas, and hot tubs to be surrounded by a safety barrier in compliance with the International Residential Code (IRC) as adopted locally. The barrier must be at least 48 inches in height and must completely enclose the pool area. Gates in pool barriers must be self-closing and self-latching, with the latch located at least 54 inches above grade on the outside of the gate or equipped with a key lock or combination lock. The barrier must not have openings, handholds, or footholds that would allow a child to climb the fence. Chain-link fences used as pool barriers must have openings no larger than 1.75 inches. The home itself may serve as one side of the barrier if doors leading to the pool area are equipped with alarms or self-closing devices. Above-ground pools with sides 48 inches or higher may use the pool wall as the barrier if the access ladder is removable or lockable. Failure to maintain required pool barriers may result in code enforcement action, fines, and potential liability for injuries. Non-compliant barriers must be corrected immediately. The building department may issue a stop-use order until the barrier meets code.
