Baytown requires pool barriers meeting International Residential Code standards as adopted by Texas. All residential pools must be enclosed by a barrier at least 48 inches high with self-closing, self-latching gates. Enforcement is through the Building Division and Code Enforcement.
The City of Baytown enforces swimming pool barrier requirements consistent with the International Residential Code (IRC) as adopted by the State of Texas. All residential swimming pools, hot tubs, and spas containing water more than 24 inches deep must be surrounded by a barrier at least 48 inches in height. Gates in pool barriers must be self-closing and self-latching, with latches located at least 54 inches above the ground or on the pool side of the gate. The barrier must not have openings that allow passage of a 4-inch sphere. Chain-link fences used as pool barriers must have no more than 1-3/4 inch diamond openings. The barrier must completely separate the pool from the residence and any adjoining properties. Above-ground pools with sides at least 48 inches high may use the pool wall as part of the barrier if the access ladder is removable or lockable. Building permits for new pools include barrier inspection as part of the final inspection process.
Failure to maintain required pool barriers is a serious safety violation. Code Enforcement at (281) 420-6585 may issue immediate corrective orders. Non-compliant barriers can result in fines and orders to drain the pool until barriers are installed.
