The City of Deer Park requires safety barriers around all residential swimming pools, spas, and hot tubs in accordance with the International Swimming Pool and Spa Code and International Residential Code as adopted locally. Pool barriers must be at least 48 inches in height measured from the finished grade on the outside of the barrier. Gates must be self-closing and self-latching with the latch mechanism located at least 54 inches above grade or otherwise inaccessible to small children. Gate openings must face away from the pool. The barrier must not have footholds, horizontal rails, or other features that would allow climbing. Openings in the barrier must not allow passage of a 4-inch sphere. Above-ground pools with walls less than 48 inches high must have an approved barrier or the access ladder must be removable and secured when not in use. Existing pools must comply with current barrier requirements. The Building Inspections division inspects pool barriers. Failure to maintain compliant pool barriers may result in immediate code violation notices with short compliance deadlines given the child safety risk. Fines up to $2,000 per day may apply. The city may require pool closure until barriers are installed.
