Deer Park regulates fence heights based on location on the property. Front yard fences are limited to 4 feet and rear/side yard fences may be up to 8 feet under the zoning ordinance. Variances require approval from the Board of Adjustment.
The City of Deer Park establishes fence height limits through the zoning ordinance. In front yards, fences may not exceed 4 feet in height. Side yard and rear yard fences may be up to 8 feet in height. Corner lot properties must maintain sight triangle clearance at intersections, which may limit fence height and placement within the visibility triangle area. Fences on corner lots within the sight triangle area are generally limited to 3 feet to maintain traffic visibility. The height is measured from the natural grade on the side of the fence facing the lower grade. Retaining wall height is added to fence height when a fence is placed on top of a retaining wall. Fences exceeding the standard height limits require a variance from the Board of Adjustment. Contact Community Development at (281) 478-7243 for fence height questions and variance applications.
Fences exceeding height limits without a variance are subject to code violation notices and must be brought into compliance. Failure to comply may result in fines up to $2,000 per day.
