Bellaire regulates fence heights through Section 24-512 of the zoning ordinance. Fences in front yards are limited to 48 inches at the property line but may go up to 8 feet when set back at least 12.5 feet from the front property line. Side and rear yard fences may be up to 8 feet. Special rules apply on major streets.
Under Section 24-512 of Chapter 24, fences in residential front yards at the property line cannot exceed 48 inches (4 feet). However, fences between 48 inches and 8 feet may be built in front yards if set back at least 12.5 feet from the front property line, provided they allow clear vision for drivers entering or backing into the street. On South Rice Avenue, Chimney Rock Road, Newcastle Drive, Bissonnet Street, and I-610 (West Loop), screening walls or fences on the front property line may not exceed 48 inches. Side and rear yard fences may be constructed up to 8 feet within property lines. The city amended the code to increase allowable fence height for fences adjacent to certain land uses. Corner lots have additional visibility requirements at intersections. Contact Development Services at (713) 662-8222 for fence permit questions.
Fences exceeding height limits or violating setback requirements face code enforcement action with fines up to $500 per day. The city may require modification or removal of noncompliant fences.
