The City of Bellaire requires safety barriers around all residential swimming pools and spas in accordance with the International Swimming Pool and Spa Code and the International Residential Code as adopted by the city. The barrier must be at least 48 inches high measured from the exterior grade and must completely surround the pool area. Gates must be self-closing and self-latching, with the latch mechanism located at least 54 inches above the ground or on the pool side of the gate where it is not accessible to small children. The barrier must not have openings, handholds, or footholds that would allow a small child to climb through or over. Horizontal rails or decorative elements that could serve as a climbing aid are prohibited on the exterior side. Chain-link fencing used as a pool barrier must have openings no larger than 1.75 inches. Doors from the home opening directly to the pool area must have self-closing devices and alarms or be equipped with safety covers meeting ASTM standards. Pool barrier inspections are required before the pool is filled and usable. Contact the Building Department at (713) 662-8222.
Pools without compliant barriers are subject to immediate enforcement. Fines up to $2,000 per day apply. The city may require the pool to be drained or covered until barriers are installed.
