Maple Grove fences must be built in a substantial, workmanlike manner of suitable material and kept in reasonable repair (Sec. 36-816(b)). Where a fence encloses the yard, a gate or recognizable ingress at least 4 feet wide is required for rear-yard access. Fences must stay on the owner's property and clear of the corner-lot sight triangle.
Construction and maintenance standards are set in Sec. 36-816(b) of the Maple Grove Zoning Ordinance: "Every fence shall be constructed in a substantial, workmanlike manner and of substantial material reasonably suited for the purpose for which the fence is proposed to be used," and every fence must be "maintained in a condition of reasonable repair" and not allowed to fall into disrepair or become a nuisance. Chain-link ("link") fences, wherever permitted, must be built so no barbed ends are at the top. Where a fence forms an enclosure that restricts access from the front to the rear yard, Sec. 36-816(c)(3) requires a gate, identifiable collapsible section, or other recognizable ingress at least 4 feet wide, located parallel to the front lot line between the side lot line and the principal structure. Fences must be entirely on the owner's property unless the neighbor agrees in writing (Sec. 36-816(a)), and may not be erected within the corner-lot traffic-visibility triangle described in Sec. 36-818 (30 feet along each property line, nothing over 30 inches tall). Public park properties are exempt from most of these requirements except the sight-triangle rule. A fence that becomes dangerous to public safety, health, or welfare is a public nuisance subject to abatement by the zoning administrator. No building permit is required for fences up to 7 feet.
A fence in disrepair or built of unsuitable material, a chain-link fence with barbed ends on top, or an enclosure lacking the required 4-foot rear-yard access can prompt a zoning correction order. A fence in the corner-lot sight triangle or over the property line is subject to removal, and a dangerous fence may be abated as a public nuisance.
