Maple Grove regulates home-based businesses through the home occupation definition in Chapter 36 (Zoning), Sec. 36-3. A home occupation is a vocation, avocation, or profession that satisfies all of the code's requirements. Evidence of the occupation must not be visible from the street or any other property, unless the activity is gardening. The occupation must be conducted within a dwelling, and entrance must be gained from within the dwelling. At no time may the occupation generate traffic or parking exceeding the type and level that typically serves single-family residences, and such traffic and parking must not constitute a nuisance or safety hazard. There may be no over-the-counter sale of merchandise produced off the premises, except for products not marketed and sold in wholesale or retail outlets. The occupation may not adversely affect the character of the permitted uses in the zoning district or violate any statute, ordinance, or rule. The term home occupation specifically excludes massage services regulated under chapter 10, article VII, and any sexually oriented business. Because these standards are built into the definition, a compliant home occupation is allowed as an accessory residential use; an activity that breaks any of the conditions is not a permitted home occupation. Operating a business that is visible from the street, draws excessive traffic or parking, involves prohibited retail sales, or otherwise breaks the Sec. 36-3 conditions exceeds the home occupation allowance and may be enforced by the zoning administrator as a zoning violation.
