Under Sec. 36-816(a), any fence must sit entirely on the owner's private property unless the adjoining owner agrees in writing to a division-line fence, and the director of fire and building inspection services may require a registered land survey to establish boundaries. Special-purpose fences that differ in construction, height, or length may be permitted in any district by a conditional use permit approved by the planning commission and city council (Sec. 36-816(e)). Although no permit is required, a fence that violates the zoning height, placement, or material rules of Sec. 36-816 is subject to enforcement by the zoning administrator, including orders to modify or remove it. Building a special-height fence without the required conditional use permit, or encroaching on a neighbor's property without written agreement, can trigger correction orders and disputes.
