Residential districts are limited to a maximum fence or wall height of eight feet measured from grade, with column and ornament caps allowed up to three feet above that height. Fences and walls must be set back at least three feet from any public right-of-way, and a minimum three-foot landscape strip is required between the fence or wall and the right-of-way. Wire and plastic fencing materials, including chain-link with plastic or wooden inserts, are prohibited adjoining a street right-of-way except in the AG-1, M-1, M-1A, and M-2 districts. Barbed wire is allowed only in the AG-1 district in connection with a legitimate agricultural use. Sight-distance triangles at corners and driveways further limit fence height near intersections. Building permits and zoning compliance are issued by Fulton County Department of Public Works, Planning & Zoning. Cities such as Atlanta, Sandy Springs, Roswell, Alpharetta, Johns Creek, and Milton apply their own zoning rules within their limits.
Fences exceeding Sec. 4.11 limits are zoning violations enforced by Fulton County Code Enforcement. General penalties under the Zoning Resolution and Sec. 1-9 of the county code can reach up to $1,000 per offense and/or up to 60 days, with each day a separate violation. Owners may be ordered to lower or remove non-conforming fences and walls to comply.
