Bend regulates fences under Bend Development Code (BDC) Chapter 3.2.500, Fences and Retaining Walls. In residential districts, a fence located in the front setback may not exceed 3.5 feet (42 inches) in height, so front-yard fences must stay low. Fences in the side and rear setbacks may be up to 6 feet tall. Outside of any required setback, fences may be up to 8 feet (this 8-foot cap also applies generally in non-residential districts). On corner lots and near driveways, alleys, and intersections, vision-clearance rules apply: within clear-vision areas, no object β fence, wall, sign, or shrub β may sit between 2 feet and 8 feet above curb level, and tree branches must be at least 8 feet up, to keep sightlines open. Retaining walls have their own limits: a retaining wall may be up to 6 feet in height, but a permit is required once it exceeds 4 feet or supports an additional load from a building or structure.
A fence that exceeds the allowed height for its location, or that blocks a required clear-vision area, violates BDC 3.2.500 and is enforced by the City of Bend through code enforcement and the permitting process; the owner may be required to lower or remove the fence.
