Quiet hours in Bend, OR — also called the noise ordinance, nighttime noise rules, or residential quiet time — define the hours during which excessive noise is prohibited.
Bend Code Chapter 5.50 sets nighttime (10:00 p.m.–7:00 a.m.) and daytime (7:00 a.m.–10:00 p.m.) noise limits measured at a neighbor's property. In residential zones the limit is 65 dBA day / 60 dBA night. Amplified sound plainly audible at a residence's property line is prohibited at night.
Bend regulates noise under Bend Code (BC) Chapter 5.50, adopted under ORS 467.100. The code defines 'Daytime' as 7:00 a.m. to 10:00 p.m. and 'Nighttime' as 10:00 p.m. to 7:00 a.m. (BC 5.50.015). Under BC 5.50.020, noise measured at a neighboring property containing a residence or other noise-sensitive unit may not exceed the listed limits: residential 65 dBA daytime / 60 dBA nighttime, commercial 70/65, and industrial 75/70. On property with no residence the cap is 85 dBA day / 80 dBA night. Separately, BC 5.50.025 bans operating a speaker or amplifier that is 'plainly audible' at the property line of a home between 10:00 p.m. and 7:00 a.m., and bans 'unnecessarily loud' yelling, shouting or singing. Sound measurements are not required to enforce the chapter (BC 5.50.010). The City Manager can issue noise permits for concerts and events under BC 5.50.035. Legal Fourth of July fireworks are exempt from 7:00 a.m. to 11:00 p.m. (BC 5.50.030).
A violation of Chapter 5.50 is a Class A civil infraction (BC 5.50.040). Each day a violation continues is a separate violation. The maximum penalty is $250 for a first violation in a one-year period, $1,500 for a second, $5,000 for a third, and $10,000 for a fourth and each subsequent violation. The property owner may be cited in addition to the person generating the noise.
