Oregon law (ORS 480.110β480.165) bans consumer use of any firework that flies into the air, explodes, or travels far on the ground β so bottle rockets, Roman candles, firecrackers, and most aerials are illegal without a state permit.
The City of Bend defers to Oregon law on fireworks. Bend Code 5.30.000 provides that 'the use of fireworks shall conform to Oregon law,' prohibits anyone under 18 from selling, keeping, possessing, using, or exploding fireworks within the City, and lets the City confiscate illegal stocks for public safety. Under Oregon law administered by the Oregon State Fire Marshal (ORS 480.110β480.165), only 'consumer' or retail-legal fireworks may be used without a permit β items such as fountains, ground spinners, and sparklers that stay on the ground and do not explode. Fireworks that fly into the air, explode, or behave in an uncontrolled manner are illegal for consumers; that category includes bottle rockets, Roman candles, firecrackers, and aerial shells. Retail-legal fireworks may be purchased in Oregon only during the sale window of June 23 to July 6. Bend's noise chapter separately allows legal Fourth-of-July fireworks noise only between 7:00 a.m. and 11:00 p.m. (BC 5.50.030). Note that local fire agencies also impose seasonal restrictions during high fire danger.
Under Bend Code 5.30.000, a fireworks violation is a Class A civil infraction for persons over 18 and a Class C civil infraction for persons under 18. Under Oregon law, possessing or using illegal fireworks can result in seizure and criminal charges; the state may also hold a person who causes a fire liable for up to $5,000 in firefighting costs plus damages. The City may confiscate and destroy illegal fireworks at the owner's expense.
