The ordinance bans starting or maintaining an outdoor fire to burn: refuse, garbage, or other waste; any yard debris including branches, leaves, and pine needles; any construction or demolition waste; and field, ditch, or weed burning. A narrow set of fires is allowed only if they comply with the adopted fire code and the Fire Department's Outdoor Burning Regulations: fire-department training fires approved by Oregon DEQ; campfires, warming fires, cooking fires, outdoor fireplaces, outdoor kiln fires, and similar approved fires no more than 3 feet in diameter; cooking pits approved by the Bend Fire Department; and weed control by the City, County, or State within developed streets. Bend Fire & Rescue advises calling before burning to confirm conditions allow it. Outside city limits, seasonal debris burning may be allowed in the surrounding rural fire district from roughly November to May, subject to weather and air-quality conditions.
A violation of the open-burning section is a Class B civil infraction under Bend Code 5.30.005(3). Burning prohibited materials, or recreational fires that exceed the size and safety conditions, can be cited. During declared high fire danger, additional burn bans from state and local fire authorities apply.
