St. Michael Code Sec. 155.030 does not require a building permit for residential fences six feet or less in height. Fences must be located entirely upon the private property of the owner and constructed in a workmanlike manner from approved materials.
Sec. 155.030 (Fences Generally) is the zoning code's main fence section. The 6-foot permit threshold means most backyard privacy fences fit under the no-permit cap, but a fence taller than 6 feet (or any fence in a corner-lot sight-triangle) requires a building permit and zoning review. Approved construction materials are limited to cut lumber, brick, fieldstone, wrought iron, maintenance-free PVC, chain link, stockade, or board-on-board wood. Fences must be located entirely on the owner's private property β straddling a lot line requires written neighbor agreement. Retaining walls over 4 feet in height (or a series of walls with greater vertical drop than horizontal distance) must be topped with a 3-foot minimum fence under the same section. Corner-lot fences cannot block sight lines at intersections.
Constructing a fence over 6 feet without a permit, or using prohibited materials, is a zoning violation enforced under Sec. 10.99 β misdemeanor with up to $1,000 fine and 90 days. The city may order the fence removed or modified at owner expense.
