St. Michael Code Sec. 155.054 requires a 6-foot non-climbing safety fence around any in-ground pool. Above-ground pools must be surrounded by a 4-foot non-climbing fence or have a latchable cover. A 6-foot construction fence is required from the moment the pool contains water during build.
Sec. 155.054 (Swimming Pools) sets pool fencing as a primary life-safety standard. In-ground pools require a 6-foot permanent fence that affords no external hand- or foot-holds and cannot be penetrated by a toddler. Above-ground pools may either install a 4-foot non-climbing fence or maintain a latchable rigid cover when not in use. A temporary 6-foot construction fence (snow-fence-style anchored every 8 feet) is required as soon as the pool contains water during construction. The fence supportive posts must be no more than 8 feet apart. Gates must self-close and self-latch out of reach of small children. These standards run in parallel with Minnesota Rules 4717.1550 (state pool code).
Operating a pool without the required barrier is a zoning/safety violation under Sec. 10.99 β misdemeanor with up to $1,000 fine and 90 days. The city may order the pool drained or covered until a compliant fence is installed.
