Per the Fences handout, no building permit is required for a residential fence EXCEPT in four situations: (a) pool, pond, or hot tub fences β any water deeper than 24 inches without a locking cover must be fenced; (b) fences over 6 feet at any point, including posts, caps, and trellises; (c) retaining walls over 4 feet from footing to top, or that support a surcharge or a fence; (d) the city's Fences and Retaining Walls page notes Ordinance 1481-23 governs the program. Land use approval (Architectural Review) is also required before constructing a fence on any property not currently developed with a single-family dwelling.
Building a permit-required fence (pool, >6 ft, retaining wall >4 ft, or non-single-family lot) without the permit or Architectural Review violates the Building Code and TDC. Engineering & Building can issue stop-work orders and pursue civil penalties.
