The West Virginia State Fire Commission adopts the International Residential Code (Appendix G/Chapter 42) and the International Swimming Pool and Spa Code as the statewide minimum standard for pool barriers. Outdoor pools, spas, and hot tubs containing water more than 24 inches deep require a permanent barrier at least 48 inches above grade on the exterior side. Openings must not allow a 4-inch sphere to pass; ground clearance is limited to 2 inches over grass and 4 inches over solid surfaces. Gates must open outward from the pool, be self-closing and self-latching, with the latch placed at least 54 inches above the ground.
Building officials may issue stop-work orders, refuse certificates of occupancy, and assess fines. Noncompliant pools cannot be filled or operated.
