Charleston's animal code (Sec. 10-114 through 10-118) defines a "dangerous dog" by conduct, not breed: a dog with a known propensity to attack, one that attacks or bites a person or animal, or one kept or trained for dog fighting. On probable cause from a humane or police officer, a municipal court judge holds a hearing and can declare the dog dangerous. Within 15 days the owner must have it microchipped, carry a $50,000.00 liability insurance policy, pay a $50.00 annual registration fee, and keep the dog confined indoors or in a locked six-foot enclosure, muzzled and leashed to four feet whenever it is outside.
Violations & Fines
Unregistered or unconfined dangerous dogs are impounded. First conviction draws a $250.00 fine; a second conviction within 24 months is $500.00 plus euthanasia of the dog. The municipal court judge cannot suspend any part of the fine.
