Florida's Residential Swimming Pool Safety Act (Ch. 515 F.S.) applies statewide and is enforced in Pasco County through the Florida Building Code and building permit process. New residential pools, spas, and hot tubs require at least one of the following: (1) a barrier not less than 48 inches high with openings that do not allow passage of a 4-inch sphere, gates that open outward with self-closing/self-latching hardware at least 54 inches above grade; (2) an approved safety pool cover per ASTM F1346; (3) exit alarms on all doors and windows with direct access to the pool; or (4) self-closing, self-latching devices on doors providing direct pool access at least 54 inches above floor. Pasco County building inspectors verify compliance at final inspection before issuing a certificate of completion. Chain link is only permitted if maximum mesh size is 1.75 inches (or with slats reducing to under 4 inches). Above-ground pools with 48-inch or taller walls may satisfy barrier rules if the ladder is removable or lockable.
Pools without compliant barriers: final inspection fails, certificate of completion withheld, pool use prohibited. FL Β§515.27 makes violation a 2nd degree misdemeanor. Drowning liability significant.
