Davenport requires residential pools and spas to have barriers meeting the International Swimming Pool and Spa Code, Chapter 305: a minimum 48-inch barrier with self-closing, self-latching gates. Swimming pools require a building permit.
Davenport's building code, Municipal Code Section 15.12.052, replaces IRC Section R327 and requires that the design and construction of pools and spas comply with the International Swimming Pool and Spa Code Chapter 305, Barrier Requirements. ISPSC Chapter 305 sets a minimum 48-inch barrier height, a maximum 2-inch gap at the bottom, openings that reject a 4-inch sphere, and gates that are self-closing and self-latching with the latch at least 54 inches high. Swimming pools require a building permit; prefabricated pools under 24 inches deep and under 5,000 gallons are permit-exempt but must still meet the barrier requirements.
A pool without a compliant barrier must be corrected before use; violations bring code enforcement and municipal-infraction fines, and owners face liability exposure for drowning accidents.
