The Florida Residential Swimming Pool Safety Act (FL Β§515.25 through Β§515.37) mandates specific barriers on every residential pool constructed after October 1, 2000. Ocoee Building Division enforces the statute together with FL Building Code Residential Chapter R4501 (swimming pool enclosures). Minimum pool barrier height is 48 inches measured from finished grade. Gates must be self-closing and self-latching; latch at least 54 inches above ground or on the pool side of the gate. Maximum gap under the fence is 2 inches (FL Β§515.29); horizontal member spacing must prevent a 4-inch sphere from passing. In addition to the barrier, the pool must have at least one approved secondary safety feature: an FL-approved pool safety cover, a door exit alarm on every dwelling access door (FL Β§515.27(1)(e)), window locks on windows opening onto the pool, or a pool alarm meeting ASTM F2208. Pools built before Oct 1, 2000 are grandfathered until property sale, at which point the buyer has 90 days to bring the barrier to code.
FL Β§515.29 violation: second-degree misdemeanor, up to 60 days jail and $500 fine. Ocoee code enforcement also issues civil citations and can refuse Certificate of Occupancy on new pools that fail final inspection.
