Pool fencing in Toledo must meet Ohio Building Code OAC 4101:8 residential pool barrier requirements: minimum 48-inch (4-foot) barrier, self-closing and self-latching gates, and no climbable features. Permits required through Building Inspection.
Every residential swimming pool, hot tub, or spa in Toledo with water depth of 24 inches or more must be enclosed by a barrier at least 48 inches (four feet) high measured from the outside ground surface. The barrier must extend around the entire pool area with no openings larger than four inches, preventing a 4-inch sphere from passing through. Gates must swing outward away from the pool, be self-closing, and have a self-latching mechanism located at least 54 inches above the ground on the pool side. Chain-link fences used as pool barriers must have mesh openings no larger than 1.75 inches unless slats are installed to reduce the opening. Above-ground pools with walls at least 48 inches tall can use the pool wall as the barrier if the ladder is removable or lockable. Existing dwellings can serve as part of the barrier if windows and doors accessing the pool area have alarms or self-closing, self-latching mechanisms. Building permits are required through the Division of Building Inspection for both pool and barrier installation, and final inspection must be passed before the pool can be filled or used.
Pool without compliant barrier: stop-use order until barrier compliance, plus fines. Drowning liability exposure is substantial if a child is injured due to a non-compliant barrier.
