All new residential pools and spas in San Joaquin County must meet the California Swimming Pool Safety Act (Health & Safety Code Β§115920-115929), which requires a 60-inch barrier plus at least two additional drowning prevention safety features selected from a seven-option list (self-latching doors with alarms, removable mesh fence, ASTM F1346 safety cover, etc.). Stricter than most states β effective January 1, 2018.
California's Swimming Pool Safety Act, codified at Health & Safety Code Β§Β§115920-115929 and enforced through California Building Code (CBC) Chapter 31B, is stricter than national standards. For any new pool, spa, or pool remodel in San Joaquin County, the permit application must show: (1) an enclosure at least 60 inches in height with less than 2 inches clearance from grade and no more than 4-inch openings; self-closing and self-latching gates with latches at least 60 inches above grade; plus (2) at least two additional safety features from the Act's list: removable mesh pool fencing (ASTM F2286), approved safety pool cover (ASTM F1346), exit alarms on doors providing direct access to the pool, self-closing and self-latching doors, a swimming pool alarm (ASTM F2208) that detects unauthorized entry, pool drain covers meeting the Virginia Graeme Baker Act, and devices providing equivalent protection. Existing pre-2018 pools must come into compliance when a permit is pulled for any remodel. San Joaquin County Building Services and the Stockton, Lodi, Manteca, and Tracy building departments inspect barriers at final pool permit. Real-estate transfers require a signed Pool Safety Disclosure (HSC Β§115925) with buyer acknowledgment. Above-ground pools may satisfy the barrier requirement if sidewalls are at least 60 inches with removable ladder.
Non-compliant pool barrier at inspection: fail permit β no pool use until corrected; additional fines $100 to $500 per day. Operating a pool without required safety features: $500 to $1,000 fine under HSC Β§115929 plus civil liability exposure if an accident occurs. Failure to disclose at sale (HSC Β§115925): rescission and damages remedy available to buyer.
