Encinitas permits recreational backyard fires under San Diego County Air Pollution Control District and California Fire Code regulations. Fires must use approved fuel in contained devices, maintain clearances, and comply with burn bans issued by the APCD during poor air quality days.
Recreational fires in Encinitas are regulated by the California Fire Code as adopted by the City and the San Diego County Air Pollution Control District (APCD) Rule 51. Portable outdoor fireplaces, chimineas, and fire bowls are permitted in residential yards when burning only clean, dry wood or manufactured logs. Fires must be in a commercially manufactured fire containment device and maintained at a manageable size not exceeding 3 feet in diameter and 2 feet in height. A minimum 15-foot clearance from structures, property lines, and combustible materials is required. An adult must be present with a fire extinguisher or garden hose readily available. Open burning of yard waste, trash, or construction debris is prohibited at all times. The APCD issues mandatory no-burn days during poor air quality conditions, and all recreational burning must cease on those days. Properties in the Wildland-Urban Interface area face additional restrictions. Contact Development Services at (760) 633-2710 for fire safety questions.
Violations are enforced by the Encinitas Fire Department at (760) 633-2800 and Code Enforcement at (760) 633-2660. Burning prohibited materials or violating no-burn days can result in APCD fines starting at $100 and fire department response charges.
