Under EMC Chapter 30.48, detached carports may sit within interior side or rear yard setbacks no closer than 5 feet to the lot line, are limited to one story / 12 ft (14 ft with 3:12 pitched roof), and must sit at least 20 ft from the sidewalk or right-of-way edge.
Encinitas regulates carports as accessory structures under Municipal Code Chapter 30.48 (Accessory Use Regulations) in conjunction with Chapter 30.16 (Residential Zones) and Chapter 30.54 (Off-Street Parking). A detached carport may be located within a required interior side yard or rear yard setback area provided that the structure is no closer than 5 feet to an interior side or rear lot line, does not cover more than 50% of the required interior side or rear yard, and is at least 6 feet from the main structure (eaves not less than 4 feet from the main structure). Carports located within a required side or rear yard setback are limited to one story and 12 feet in height, with roofs pitched not less than 3:12 permitted to extend an additional 2 feet to a maximum 14 feet at the peak. There must be a minimum setback of 20 feet from a garage or carport to the nearest edge of a sidewalk, or where no sidewalk exists, the easement or right-of-way edge of a private or public street, to allow a vehicle to park on the driveway apron without overhanging the public way. A detached carport must meet the front-yard and street-side-yard setbacks of the main building. Up to 400 square feet per dwelling unit is allowed for a garage or carport, and a minimum of 200 cubic feet of lockable enclosed storage per unit must be provided within a garage, carport, or main building. Carports must comply with California Building Code structural requirements and need a building permit. In the Coastal Zone, additional Coastal Development Permit review may apply if the structure is in the appeal zone or affects coastal resources. Under California ADU law (Gov. Code 65852.2) and SB 1211 (effective Jan 1, 2025), if a carport is demolished or converted to build an ADU, replacement parking is not required.
Carports closer than 5 ft to a side/rear lot line, exceeding 12 ft (or 14 ft with pitched roof), within 20 ft of the sidewalk, or built without a building permit are subject to code enforcement, stop-work orders, and removal under EMC Chapter 30.48. Coastal Zone projects without a required Coastal Development Permit may also face Coastal Commission action.
