Encinitas enforces California Building Code and Fire Code requirements for smoke alarms and carbon monoxide detectors in all residences. The Encinitas Fire Department, part of the Encinitas Fire Protection District, conducts inspections and requires upgrades at sale or remodel.
All residential properties in Encinitas must comply with California Health & Safety Code Sections 13113.7 and 17926 for smoke alarms and carbon monoxide detectors. Smoke alarms are required in every bedroom, outside each sleeping area, and on every level of the home including basements. Carbon monoxide detectors are required on every level with a fuel-burning appliance or attached garage. Since January 1, 2014, all replacement smoke alarms must be 10-year sealed lithium battery units or hardwired with battery backup. Upon sale of a dwelling, the seller must provide a written statement confirming compliant smoke alarms and CO detectors are installed. All new construction and remodels requiring permits must include hardwired interconnected alarms per current California Building Code. Contact the Encinitas Fire Department at (760) 633-2800 for fire safety inspections.
Non-compliance is enforced by the Encinitas Fire Department and Code Enforcement at (760) 633-2660. Violations result in correction notices and potential fines. Failure to provide compliant alarms at point of sale can delay or void real estate transactions.
