Little Elm, TX Fire Regulations: Brush Clearance (2026)

Little Elm regulates brush clearance burning under Sec. 50-108 of the Code of Ordinances, incorporating the 2018 International Fire Code with local amendments. An annual burn permit is required from the Little Elm Fire Department, obtained through the MyGov Permitting Portal at a cost of $25. Three conditions must be met before any outdoor burning: the permit must be current, state guidelines from the Texas Commission on Environmental Quality (TCEQ) must be followed per Appendices C and D, and burning is only allowed on designated burn days as determined by the Denton County Fire Marshal's Office. Acceptable materials for open burning include trees, brush, grass, and other dry plant growth for land clearing operations where no practical alternative to burning exists. Open burning locations must be not less than 300 feet from any structure, with provisions to prevent fire spread within that distance. All open burning, trench burns, bonfires, and recreational fires must be constantly attended until fully extinguished. Only property owners may apply for burn permits. During Denton County fire emergencies, all outdoor burning is prohibited regardless of permit status.
