Under 72 P.S. Section 9401 (Act 43), aerial consumer fireworks are legal year-round for purchase and use by persons 18 and older. The 150-foot setback from occupied structures effectively bans discharge on most Allegheny County residential lots. Fireworks cannot be discharged on public or private property without owner permission, on any public roadway, or while under the influence. State fireworks tax is 12% on top of 6% sales tax. Many Allegheny County municipalities have adopted ordinances restricting discharge to specific holidays (July 2-4, Dec 31-Jan 1) and hours (typically 10am-10pm, extended to 1am on holidays).
