Fireworks are illegal statewide in New York under Penal Law Β§270.00. Sparklers legalized in 2015 but NYC and Nassau County opted out. All fireworks remain illegal in Rockland County.
NY Penal Law Β§270.00 makes possession of fireworks a criminal offense statewide. In 2015, New York legalized sparklers and ground-based sparkling devices, but allowed counties to opt out. NYC and Nassau County opted out, keeping all fireworks and sparklers illegal. In Rockland County, all consumer fireworks including sparklers are banned. Professional displays require FDNY permits. Illegal fireworks are a major enforcement issue, especially around July 4th. NYPD and FDNY conduct joint enforcement operations.
Possession of fireworks: Class B misdemeanor, up to 3 months jail and $500. Dangerous fireworks: Class A misdemeanor, up to 1 year. FDNY seizure.
