Carmel does not set its own smoke detector spacing standard. The City adopts the Building Rules of the Indiana Fire Prevention and Building Safety Commission by reference (Carmel City Code Chapter 7), and the Carmel Fire Prevention Bureau enforces the Indiana Fire Code adopted by the State. Smoke detector requirements therefore come from Indiana law. Under IC 22-11-18-3.5, a dwelling must have at least one functional smoke detector installed outside each sleeping area in the immediate vicinity of the bedrooms and on every level of the home, including the basement. Detectors must be installed according to the manufacturer's instructions on the ceiling, or on a wall not less than four inches and not more than twelve inches from the ceiling, and may not be recessed into the ceiling. For new construction, the Indiana building and fire codes require interconnected alarms so that activation of one alarm sounds all alarms within a dwelling unit, and alarms in each sleeping room and outside sleeping areas. For rentals, Indiana law makes the landlord responsible for installing required detectors and for repairing or replacing a malfunctioning detector within seven days of written notice from the tenant.
Operating a rental dwelling without required functional smoke detectors, or failing to repair or replace a malfunctioning detector within seven days of tenant notice, violates Indiana smoke detector law (IC 22-11-18-3.5) as enforced through Carmel's adopted codes.
