Brazoria County does not add its own smoke-detector rule for existing unincorporated homes; enforcement of the building code happens through city permitting where applicable. The Property Code requirement applies to landlords everywhere in Texas.
A landlord who fails to install or repair smoke alarms after proper tenant request may face tenant remedies, civil penalties of one month's rent plus $100, actual damages, and attorney's fees under the Property Code.
