For rental housing statewide, Texas Property Code §92.255 requires a landlord to install at least one smoke alarm in each separate bedroom, in the corridor serving bedrooms, and on each level of a multi-level unit. Newer units must generally be interconnected and hard-wired. Owner-occupied homes are governed by the building code in force when built – the International Residential Code requires smoke alarms in each sleeping room, outside sleeping areas, and on every story. Brazoria County does not add its own smoke-detector rule for existing unincorporated homes; enforcement of the building code happens through city permitting where applicable. The Property Code requirement applies to landlords everywhere in Texas.
A landlord who fails to install or repair smoke alarms after proper tenant request may face tenant remedies, civil penalties of one month's rent plus $100, actual damages, and attorney's fees under the Property Code.
