Prior Lake adopts the Minnesota State Fire Code and Minn. Stat. Sec. 299F.362, which require smoke alarms in every sleeping room, immediately outside each sleeping area, and on each level of the dwelling.
Through Chapter 3 (Building Codes) of the Prior Lake City Code, the city enforces the Minnesota State Building Code and Minnesota State Fire Code. These adopt the State Smoke Alarm law (Minn. Stat. Sec. 299F.362), which mandates approved smoke alarms in (a) each sleeping room, (b) the hallway immediately outside each separate sleeping area, and (c) every story of the dwelling including basements. Alarms must be hardwired with battery backup in new construction; replacements in existing homes may use 10-year sealed lithium batteries. Carbon monoxide alarms are required within 10 feet of each room used for sleeping under Minn. Stat. Sec. 299F.50. Landlords must verify functioning alarms at the start of each tenancy.
Failure to install required smoke or CO alarms is a misdemeanor under the State Fire Code. Landlord violations can result in civil penalties through Scott County court enforcement.
