Florida Statute Chapter 720 allows HOAs to enforce architectural standards through their governing documents. Associations must apply standards consistently and provide written notice of violations with an opportunity to cure. Florida law prohibits HOAs from restricting Florida-friendly landscaping, solar panels, and certain flagpoles.
Under Florida Statute Chapter 720, HOA architectural review authority derives from the association's Declaration of Covenants, Conditions, and Restrictions (CC&Rs) and any separately adopted architectural guidelines. The architectural review committee (ARC) must apply standards uniformly to all members. Section 720.3075 requires the association to provide written notice of any covenant violation before taking enforcement action, including a specific description of the violation and a reasonable time to cure (typically 14-30 days). Florida law restricts HOA authority in several areas: Section 720.3075(4) prohibits associations from restricting Florida-friendly landscaping (as defined by the Florida-Friendly Landscaping program); Section 163.04 protects the right to install solar collectors and other energy devices; and Section 720.304 protects the display of the American flag on a freestanding flagpole. HOAs may not require use of a specific contractor for exterior modifications, but may require compliance with building code standards. Jacksonville does not impose additional municipal regulations on HOA architectural review.
