Texas HOAs may levy regular and special assessments as authorized by recorded CCRs. TX Property Code Section 209.0063 requires payments be applied in the following order: delinquent assessments, current assessments, attorney fees and costs, fines, and other amounts. HOAs must send written notice of delinquency specifying the amount owed before taking collection action (Section 209.0064). Owners who request a payment plan in writing before foreclosure proceedings may obtain a plan of at least three months under Section 209.0062. Section 209.0092 requires HOAs to obtain a court order before nonjudicial foreclosure of an assessment lien, providing judicial oversight of HOA foreclosures since 2011 amendments. Condominiums under Chapter 82 have parallel but distinct foreclosure procedures. Late fees, interest, and attorney fees must be reasonable and authorized by CCRs. HOAs must provide resale certificates disclosing outstanding assessments when an owner sells.
HOA violations: owner remedies include suit for damages, attorney fees, and setting aside wrongful foreclosure. Members failing to pay assessments face liens and potential foreclosure after court order.
