CCR enforcement in Texas HOAs follows the Property Owners Association Act at TX Property Code Chapter 209 (POA Act). Section 209.006 mandates certified mail pre-enforcement notice identifying the violation, amount of any fine, and cure period before any fine, suspension, or lawsuit other than assessment collection. Section 209.007 grants a hearing right before the board. Section 209.0051 applies open meeting rules. CCRs cannot enforce certain restrictions that conflict with Chapter 202 owner rights: solar devices (202.010), rain barrels (202.018), flags (202.011), religious displays (202.019), standby generators (202.019), xeriscape and drought-tolerant landscaping (202.007 with limits). Section 209.0041 permits amendments to CCRs with owner votes specified in governing documents but generally requiring supermajority approval. Selective or arbitrary enforcement can give rise to equitable defenses. Lubbock has active HOAs throughout newer subdivisions such as Preston Manor, Vintage Township, and parts of Regal Park; older core neighborhoods typically have deed restrictions without active associations.
