Enterprise HOA Rules: CC&R Enforcement Rules (2026)

Clark County HOAs enforce CC and Rs under strict NRS 116 procedures. NRS 116.31031 requires written notice of alleged violations to the owner, a reasonable opportunity to cure, and a hearing before fines can be imposed. Fines per violation are capped by statute except for health, safety, or architectural integrity violations. Continuing violations may be cited once per specified period. NRS 116.31065 requires enforcement to be reasonable and consistent across all owners. Selective, discriminatory, or retaliatory enforcement is prohibited and can be challenged through NRED. Liens for unpaid fines are subordinate to assessment liens and cannot trigger super-priority foreclosure status. Common violations cited in Clark County master-planned communities include unapproved paint colors, flags, political signs, RV and boat parking in driveways, holiday decorations left too long, trash cans visible on non-collection days, landscape neglect, and unapproved solar or satellite installations. The NRED Ombudsman fields frequent complaints about aggressive fines in Summerlin, Anthem, and Inspirada. Owners should document violations, request the specific CC and R section, and preserve notices.
