NJ Community Dispute Resolution Centers (part of the NJ Judiciary) also offer free mediation for HOA and neighbor disputes. Unresolved matters proceed to the Chancery or Law Division of Hudson County Superior Court. The NJ Department of Community Affairs regulates developer compliance with PREDFDA but does not mediate internal HOA disputes.
Failure to offer ADR: N.J.S.A. 46:8B-14(k) violation; courts may dismiss premature lawsuits for failure to exhaust ADR. Bad-faith ADR conduct may result in attorneys' fees.
