A fine may then be assessed if the owner repeats the same violation within a year or fails to cure. The fine must be for a violation listed in the governing documents and "in the amount specifically provided for in the association's governing documents," or commensurate with the violation — Utah sets no statutory maximum. An owner may request an informal hearing "within 30 days after" receiving notice of the fine, and if timely requested, "no interest or late fees may accrue" until a final decision issues. The owner may appeal by civil action within 180 days.
