HOAs enforce CCRs through fines, liens, and legal action but must follow Utah Code 57-8a notice, hearing, and proportionality requirements.
Under Utah Code 57-8a-208, HOAs can impose fines for CCR violations only after providing written notice of the violation, a reasonable opportunity to cure, and a hearing if requested. Fines must be reasonable in amount and proportional to the violation. Continuing violations can accrue daily fines if CCRs authorize. HOAs cannot selectively enforce rules, cannot enforce rules not contained in recorded CCRs or properly adopted rules, and cannot retaliate against members for reporting violations. Unpaid fines become liens subject to assessment collection procedures.
