HOAs enforce CC&Rs through notice, fines, and legal action; Utah requires notice and opportunity to cure.
Before imposing fines, HOAs in West Valley City (and throughout Utah) must provide written notice of the violation, a reasonable opportunity to cure, and a hearing if requested, per Utah Code 57-8a-208. Fines must be reasonable and consistent with published schedules. Enforcement must be uniform; selective enforcement is a defense. Owners can record a notice challenging improper enforcement. City code enforcement handles municipal violations separately from HOA CC&Rs.
