Irving has no municipal ordinance regulating residential holiday light displays. Light displays are governed by HOA covenants and deed restrictions, particularly within Las Colinas Association, Valley Ranch, and Hackberry Creek. Texas Property Code Section 202.018 protects holiday displays of religious significance from total HOA bans. Persistent light trespass could theoretically be a nuisance, but the city rarely enforces.
Irving's Code of Ordinances contains no provisions setting when residential holiday lights may be installed, when they must come down, brightness limits, or animation restrictions. Chapter 22 (Noise) and the city's general nuisance provisions do not address holiday lighting. The Texas Property Code addresses HOA authority: Section 202.018 limits a property owners' association's ability to prohibit display of religious items on the entry of a dwelling, and Section 202.019 protects religious displays generally. Real regulation in Irving comes from subdivision deed restrictions and HOA covenants in master-planned communities β most notably the Las Colinas Association, which maintains active architectural review and design standards for all Las Colinas properties under deed-recorded covenants. Typical HOA windows in DFW-area communities are November 1 through January 31 for winter holiday lighting, with prohibitions on commercial-grade audio amplification, flashing/strobe lighting visible from streets, and laser projections. Irving's downtown holiday lighting program and the Las Colinas seasonal lighting installations are administered separately by the city and the Las Colinas Association respectively, and do not apply to private residential displays. Tex. Bus. & Com. Code Section 17.50 (Texas Deceptive Trade Practices Act) is occasionally invoked against contractors installing lights without disclosed terms, but is not a residential display rule.
No municipal enforcement against residential holiday lights. HOA violations result in covenant-based fines, typically starting at $25-$100 per occurrence escalating to liens for unpaid amounts under Texas Property Code Chapter 202. Las Colinas Association enforcement is particularly active. Religious display restrictions imposed by HOAs may be challenged under Texas Property Code Section 202.018.
