Irving does not maintain breed-specific legislation banning particular dog breeds. Instead, the city regulates dangerous and vicious dogs regardless of breed under Chapter 6 of the Code of Ordinances and Texas Health and Safety Code Chapter 822 (Dangerous Dogs). Dogs that have made unprovoked attacks or behaved in a manner that a reasonable person would believe poses an unjustified imminent threat may be declared dangerous. Owners of declared dangerous dogs must register the dog, maintain secure enclosures, and carry liability insurance or provide financial responsibility. Texas state law preempts some aspects of local dangerous dog regulation. The Irving Animal Services division handles dangerous dog investigations.
