Richardson does not have breed-specific legislation. Under Sec. 5-7, any animal may be declared dangerous or vicious through a complaint and hearing process with the Director of Health. Dangerous animals may be ordered removed from the city or destroyed.
Richardson Code Section 5-1 defines 'vicious or dangerous animal' broadly as any animal capable of inflicting serious harm, known to have attack tendencies, certified dangerous by a veterinarian, or that commits an unprovoked attack. Section 5-7 establishes the process: a sworn written complaint must be filed with the Environmental Health Department. A hearing before the Director of Health is held within 20 days. If the animal is found dangerous, it may be ordered permanently removed from the city or destroyed. Owners may appeal to the municipal court judge within 5 days. During appeal, the animal must be kept at the animal shelter or veterinary clinic. There are no breed-specific bans; any animal of any breed may be subject to this process based on behavior.
Keeping a declared dangerous animal within the city is an offense under Sec. 5-9(3). Failure to surrender an animal ordered destroyed or removed is also an offense.
