Beekeeping in Irving is permitted subject to the general animal nuisance provisions of Chapter 6 and the Texas Apiary Inspection Act (Texas Agriculture Code Chapter 131). Texas Property Code Β§ 202.007 prohibits HOAs from banning beekeeping on properties of at least 1/4 acre if the beekeeper follows the state apiary standards. Beekeepers must register with the Texas Apiary Inspection Service. Hives must be placed to minimize contact with the public and neighbors, with adequate water sources to prevent bees from seeking water on neighboring properties. The colony must not create a public nuisance. Irving does not require a separate city beekeeping permit beyond compliance with state law.
Bee colonies creating a nuisance may be cited under Ch. 6. State apiary violations enforced by TX Dept. of Agriculture.
