Section 15-3(a) makes it unlawful for anyone to construct, repair, or replace a fence or any part of a fence in Irving without first obtaining a fence permit, and Section 15-2 requires the applicant to submit a completed permit application with plans of the proposed fence; the director can require additional construction documents from a registered design professional for special conditions. An application sits open for ninety days before it expires if no permit is issued, though a single ninety-day extension is available. Section 15-3(b) waives the permit fee, though not the permit itself, for repairing, partially replacing, or building a new residential fence section of fifty linear feet or less that otherwise complies with the chapter; routine maintenance such as replacing individual pickets, rails, or posts that does not amount to replacing an entire fence section is exempt from both the permit and the fee.

Once issued, a permit becomes invalid if the authorized work is not started within ninety days, or if it is suspended or abandoned for ninety days after starting, though the director may grant one ninety-day extension. The director can also suspend or revoke a permit issued in error, on incorrect information, or in violation of law under Section 15-3(d). Fence permit fees themselves are set through the inspections department's fee schedule referenced in Section 15-4, and every permitted fence must remain accessible for inspection under Section 15-5 until the director approves the work.
