UDO Article 11 governs signs in Durham. Section 11.3.3 prohibits 'fluttering, spinning, windblown or inflated devices including pennants, propeller discs, flags or banners' when used as commercial signage, with an exception for temporary uses in the Downtown Tier authorized under UDO 3.12 and 5.5. The prohibition targets commercial wind-driven and inflated attention-getting devices outside businesses, not residential holiday decorations. A non-commercial inflatable Santa, snowman, pumpkin, or similar holiday character in a residential yard does not meet the UDO definition of a regulated sign and falls outside Article 11. UDO 11.6 lists signs requiring permits and excludes non-commercial residential decorations. Inflatables placed within a public right-of-way, on a city sidewalk, or in a way that obstructs visibility at a driveway or intersection may be cited under Durham city code Chapter 26 (nuisance) or Chapter 46 (public safety / obstruction). HOAs may regulate residential inflatables under recorded covenants pursuant to NCGS 47F and enforce them in civil court. Commercial properties using inflatable advertising remain prohibited under UDO 11.3.3.
Commercial use of prohibited inflatable signage is a UDO violation enforced under Article 16, starting with a Notice of Violation. Residential inflatables in the right-of-way may be cited under city code Chapter 46 obstruction provisions, including removal at the owner's expense. HOA violations are enforced privately.
