Permitted products include non-potentially hazardous foods: baked goods without cream filling, jams and jellies using approved recipes, dry goods, candy, honey, and popcorn. Potentially hazardous foods requiring refrigeration (cheesecake, cream pies, meat, fish) are not permitted. PA does not cap total revenue under Limited Food Establishment (unlike some states' cottage food laws). Labels must include product name, ingredients in descending order by weight, allergen disclosure, net weight, producer name/address, and the phrase "Made in a home kitchen that has not been subject to Pennsylvania's food safety regulations." Sales may be made direct to consumer, at farmers markets, and retail (including wholesale under some conditions).
Operating without PDA registration: cease and desist and fines up to $1,000 per offense. Selling non-permitted foods: seizure and injunction. Labeling violations: warnings then citations up to $500.
