Florida's Cottage Food Law (FL ยง500.80) preempts local regulation. Duval County cannot require a home kitchen inspection, permit, or cottage food license. Allowed products: non-potentially-hazardous baked goods, jams/jellies, honey, dry mixes, candies, granola, etc. Packaging must include producer name, address, ingredients, allergen statement, net weight, and the cottage food disclaimer. Revenue cap raised to $250,000 annual gross by 2021 HB 663 amendment. A Local Business Tax Receipt is still required for any home business operating in Duval County.
State enforcement via FDACS if violations of labeling or revenue cap. Non-cottage food products (meat, dairy, canned vegetables) require commercial licensing.
